Why did Obama vote against John Roberts? Why did he filibuster Sam Alito?

    He felt that as a Senator it was his duty to reject any nominee from a Republican President.

  • GW Bush, if you recall, tended to pick highly rightwing fundamentalist judicial nominees, and Judge Alito was one such nominee. Chief Justice John Roberts was not filibustered, but he was questioned in depth, as he should have been, to determine whether or not Roberts was a fanatic or zealot. I listened in on the Confirmation Hearings for both Roberts and then the arrogant and very contemptuous Alito---and I had hoped that Alito would not be confirmed. With John Roberts, however, a Democratic attorney who had appeared before then-Judge Roberts in trial spoke very highly of the fairness with which Roberts conducted himself on the bench, and this put my mind at ease somewhat in having Roberts confirmed. Alito and Clarence Thomas are, in my opinion, not assets to the Supreme Court.

    Once again:

    Senators have a right to vote for or against any nominee as suits their conscience. Hopefully they do it for a good reason instead of "NYAH NYAH I'M DOING THE OPPOSITE OF YOU".

    However, in addition to that right, they also have a DUTY to take that power seriously. When party leadership says "we're not even going to consider your nominee, whoever it is, until you get out of office," that is not acceptable.

    Honestly, part of me says that Obama should nominate McConnell just to see what happens :D

    Roberts and Alioto got confirmed by the whole Senate, didn't they? All we ask is the Senate to bring Obama's nominee up for a vote after the usual hearings.. is that so hard to understand?

    Because he could.

    But, you WILL note that BOTH are now Supreme Court Justices.

    Why? Because the Dems allowed a VOTE.

    Because they were nominated by a REP president and for other reason.
